Senate Committee hands down its report into the Fair Work Bill

The Senate's Standing Committee on Education, Employment and Workplace Relations has recommended the passing of the Rudd Government's Fair Work Bill.

The review by the committee was passed by a majority of Committee members, who have recommended 13 amendments including passing the bill "without delay". Follow this link to read the full report. The majority report also recommended:

  • extending the right to request flexible working arrangements to employees caring for a child with a disability or an adults in need of care
  • ability to provide for dispute resolution of flexible work arrangements in enterprise agreements
  • include information on individual flexibility agremeents in the Fair Work Information Statement, and provide the statement in community languages
  • extention of the period to access a proposed agreement to 14 days
  • provide a 14 day time limit for appeals against unfair dismissal to be lodged with Fair Work Australia
  • Fair Dismissal Code to provide that a warning be provided in writing
  • clarify that where industrial action threatens harm, the threat should be imminent, and the harm to the third party should be economic harm
  • exemption for Community Legal Centres being required to seek leave to appear before the FWA
  • a probationary period after a transfer of business should not be required to recommence and they should be treated as existing employees
  • provision of a safety net of employment conditions for workers in the coasting trade and protections for outworkers
